Terms of Service

1. Acceptance of Terms
By accessing or using HearMeOut ("the App", "Service", "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Eligibility
You must be at least 18 years old to use HearMeOut. By using the App, you represent and warrant that you are 18 years of age or older.
We do not verify your age, university affiliation, or identity. You are solely responsible for ensuring you meet these eligibility requirements.
3. Account-Free Service
HearMeOut does not require you to create an account or log in. Your access to the Service is based on your location and device identifier. You understand that without traditional accounts, we have limited ability to restore access if you lose your device or if your device is banned for violating these Terms.
4. Acceptable Use
What's NOT Allowed
You agree NOT to use HearMeOut to:
- Harass, threaten, intimidate, or bully other users
- Share hate speech, discriminatory content, or violent threats
- Engage in sexual harassment or share sexually explicit content
- Encourage or promote illegal activities
- Impersonate others or misrepresent your identity
- Spam, advertise products/services, or solicit others
- Share personal information of others without consent
- Attempt to hack, disrupt, or damage the Service
- Use automated tools, bots, or scripts to access the Service
- Violate any local, state, national, or international laws
What IS Allowed
You're here to have conversations with other college students. Talk about classes, life, random stuff—whatever. Just be respectful and don't be a jerk.
5. Content and Conduct
No Recording Policy: Currently, HearMeOut does not record voice conversations. All conversations are live and temporary. Once a conversation ends, it's gone.
User Responsibility: You are solely responsible for your conduct and any content you share through voice conversations on the Platform.
We Don't Monitor: We do not actively monitor conversations. However, we may investigate reports of violations and take appropriate action.
6. Reporting and Moderation
If you encounter a user violating these Terms, you can report them using the "Report" feature within the App or by contacting us at info@hearmeout.one. We reserve the right to:
- Investigate reported violations
- Temporarily or permanently ban devices associated with violations of these Terms
- Remove access to the Service for any user at our sole discretion
- Cooperate with law enforcement if illegal activity is reported
Device-Based Enforcement: Since HearMeOut operates without traditional accounts, we enforce violations by restricting device access. If your device is banned, you will not be able to access the Service from that device. Bans are based on conduct, not identity, and may be permanent depending on the severity of the violation.
7. Disclaimers and Limitations of Liability
Use at Your Own Risk
HearMeOut is provided "as is" without any warranties. You understand and agree that:
- We do not verify the identity, age, or university affiliation of users
- We are not responsible for the conduct or content of other users
- You interact with other users at your own risk
- We cannot guarantee the Service will always be available, secure, or error-free
- We are not liable for any harm, damages, or losses resulting from your use of the Service
No Liability for User Conduct
We are not responsible for:
- Offensive, inappropriate, or illegal content shared by users
- Harassment, threats, or harm caused by other users
- False information or misrepresentation by users
- Any interactions or relationships formed through the Service
Maximum Liability
To the maximum extent permitted by law, HearMeOut's total liability to you for any claims arising from your use of the Service is limited to the amount you paid to use the Service (which is $0, since the Service is free).
8. Intellectual Property
The HearMeOut app, including its design, code, branding, and content, is owned by HearMeOut and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
9. Service Availability
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time without notice
- Change features, functionality, or availability of the Service
- Update these Terms of Service (we'll notify you of material changes)
We are not liable for any loss or inconvenience caused by service interruptions or changes.
10. Indemnification
You agree to defend, indemnify, and hold harmless HearMeOut, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your conduct on the Platform
11. Termination
We may terminate or suspend your access to HearMeOut at any time, for any reason, without notice. This includes (but is not limited to) violations of these Terms, suspicious activity, or at our sole discretion.
You may stop using the Service at any time by simply deleting the app from your device.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with Delaware law, except where prohibited by law.
You agree to resolve disputes individually and waive any right to participate in class-action lawsuits.
13. Privacy
Your use of HearMeOut is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify users through the App or via email (if we have it). Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
